ETHICAL ISSUES: Balancing Competing Legislative Requirements (Webinar Series)

Clinicians are confronted on an almost daily basis to balance competing legislative requirements. This (4) part webinar series will examine and use three primary pieces of legislation: Personal Health Information and Protection Act (2004) The Youth Criminal Justice Act (2002) and Child Family Services Act (1990). The webinar series will review, through illustrative case example, how these three Legislative Acts can adversely affect treatment planning and service coordination. The process of balancing the spirit of each act can frustrate the clinical process and the professional.
Understanding the intent of each act and their application in matters related to clinical services is essential for good ethical practice, which benefits the client, the professional, and agency or institution. A matrix or a framework for viewing each Act in the context of treatment will be provided. As the cases and the needs of children and youth increase, the urgency to provide quality service becomes more challenging. In order to ensure program fidelity and effectiveness, professionals and agencies will increasingly have to open themselves up to self-reflection and agency wide review and monitoring. All of this happens within the context of various pieces of legislation.
This training will provide participants with a thorough understanding and appreciation for the evolution of ethics. It will assist the participants in understanding how to incorporate good ethical practice in both direct service and in the evaluation or research of that service. Participants will gain an understanding of the legislative requirements and their affect on both service and ethical decision-making.
Participants will learn:
• How to separate ethics from morality and legality
• The intent of the three pieces of legislation
• How these three distinct legislations can complement and confound treatment goals
• The history of ethics
• Ethical decision making
• About a template for ethical decision making
• Increased confidence that service is being provided in an ethical manner.
Clinicians, direct service providers as well as management may benefit from this 6 hour webinar series designed to focus on ethical decision making within the context of the legal requirements for service providers.
